Il est primordial que chaque copropri\u00e9taire soit l\u00e0 pour donner son avis.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;font-size: 24px;padding-left: 40px\"><span style=\"color: #230a59\"><strong>Quels sont les diff\u00e9rents types d\u2019AG ?<\/strong><\/span><\/h3>\n<p style=\"text-align: justify\">Il existe deux types d\u2019assembl\u00e9e g\u00e9n\u00e9rale de copropri\u00e9t\u00e9\u00a0:<\/p>\n<ul>\n<li style=\"text-align: justify\"><strong>L\u2019assembl\u00e9e g\u00e9n\u00e9rale ordinaire, AGO<\/strong>, qui a lieu une fois par an \u00e0 l\u2019initiative du syndic conform\u00e9ment aux statuts de la copropri\u00e9t\u00e9<\/li>\n<li style=\"text-align: justify\"><strong>L\u2019assembl\u00e9e g\u00e9n\u00e9rale extraordinaire, AGE<\/strong>, qui est convoqu\u00e9e selon les besoins par les copropri\u00e9taires pour la prise de d\u00e9cisions rapides qui ne peuvent attendre l\u2019AGO. Elle peut \u00e9galement \u00eatre convoqu\u00e9e par le syndic.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">L\u2019assembl\u00e9e g\u00e9n\u00e9rale ordinaire doit \u00eatre tenue dans une <strong>p\u00e9riode de 15\u00a0jours chaque ann\u00e9e<\/strong> conform\u00e9ment au r\u00e8glement d&rsquo;ordre int\u00e9rieur. Seule une raison exceptionnelle peut modifier cette p\u00e9riode.<\/p>\n<p style=\"text-align: justify\">{{cta(&lsquo;fe35a083-cfe9-4dc9-9be7-00884a0e2267&rsquo;)}}<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;font-size: 30px\"><span style=\"color: #230a59\"><strong>Les \u00e9tapes cl\u00e9s d\u2019une assembl\u00e9e g\u00e9n\u00e9rale<\/strong><\/span><\/h2>\n<p style=\"text-align: justify\"><strong><br \/>\nL\u2019organisation de l\u2019assembl\u00e9e g\u00e9n\u00e9rale respecte une proc\u00e9dure stricte<\/strong> que le syndic de copropri\u00e9t\u00e9 doit conna\u00eetre. Quatre \u00e9tapes cl\u00e9s permettent de r\u00e9aliser une assembl\u00e9e g\u00e9n\u00e9rale 100\u00a0% dans les r\u00e8gles.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;padding-left: 40px\"><strong style=\"color: #230a59;font-family: raisonne-demibold;font-size: 24px;background-color: transparent\">La r\u00e9daction de l\u2019ordre du jour<\/strong><\/p>\n<p style=\"text-align: justify\">Un <strong>ordre du jour est \u00e9tabli<\/strong> par le syndic de copropri\u00e9t\u00e9 avant chaque AG de copropri\u00e9t\u00e9. Il s\u2019impose pour centrer les \u00e9changes sur des sujets pr\u00e9cis et importants \u00e0 aborder.<\/p>\n<p style=\"text-align: justify\">L\u2019ordre du jour \u00e9vite que les discussions d\u00e9rivent vers des questions secondaires et que les d\u00e9cisions principales soient ajourn\u00e9es. Il permet aussi de <strong>limiter la dur\u00e9e de l\u2019assembl\u00e9e g\u00e9n\u00e9rale<\/strong> \u00e0 quelques heures bien utilis\u00e9es !<\/p>\n<p style=\"text-align: justify\">Selon la loi sur la copropri\u00e9t\u00e9 en Belgique, <strong>l\u2019ordre du jour doit contenir les points suivants soumis lors de l\u2019AG<\/strong>\u00a0:<\/p>\n<ul>\n<li style=\"text-align: justify\">Le rapport d\u2019\u00e9valuation des contrats de fournitures r\u00e9guli\u00e8res (article 3.89, \u00a7 5, 12\u00b0).<\/li>\n<li style=\"text-align: justify\">Un point relatif \u00e0 l\u2019approbation des budgets pr\u00e9visionnels pour les d\u00e9penses courantes et les frais extraordinaires pr\u00e9visibles (article 3.89, \u00a7 5, 16\u00b0).<\/li>\n<li style=\"text-align: justify\">Les points soumis par un ou plusieurs copropri\u00e9taires, ou le conseil de copropri\u00e9t\u00e9. Ces points doivent \u00eatre transmis au syndic au moins trois semaines avant la p\u00e9riode \u00e0 laquelle l\u2019assembl\u00e9e g\u00e9n\u00e9rale doit avoir lieu (article 3.87, \u00a7 3, al. 1).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;font-size: 24px;padding-left: 40px\"><span style=\"color: #230a59\"><strong>La convocation \u00e0 l\u2019AG<\/strong><\/span><\/h3>\n<p style=\"text-align: justify\">Le syndic de copropri\u00e9t\u00e9 doit <strong>transmettre \u00e0 chaque copropri\u00e9taire la convocation \u00e0 l\u2019assembl\u00e9e g\u00e9n\u00e9rale par courrier recommand\u00e9<\/strong>. Il peut utiliser un autre moyen de communication uniquement si le propri\u00e9taire a \u00e9mis son accord explicite et \u00e9crit.<\/p>\n<p style=\"text-align: justify\">La convocation \u00e0 l\u2019AG contient\u00a0:<\/p>\n<ul>\n<li style=\"text-align: justify\">L\u2019ordre du jour<\/li>\n<li style=\"text-align: justify\">La date et l\u2019heure de la r\u00e9union<\/li>\n<li style=\"text-align: justify\">L\u2019adresse o\u00f9 aura lieu l\u2019AG<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Sauf information contraire dans le r\u00e8glement d&rsquo;ordre int\u00e9rieur, <strong>un d\u00e9lai minimum de 15\u00a0jours entre l\u2019envoi de la convocation et la tenue de l\u2019assembl\u00e9e g\u00e9n\u00e9rale est requis<\/strong>. Toutefois, inutile de l\u2019envoyer des mois \u00e0 l\u2019avance, car l\u2019ordre du jour serait incomplet et le rendez-vous pourrait \u00eatre oubli\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;font-size: 24px;padding-left: 40px\"><span style=\"color: #230a59\"><strong>Le vote<\/strong><\/span><\/h3>\n<p style=\"text-align: justify\">Pour qu\u2019une d\u00e9cision soit valid\u00e9e lors d\u2019une assembl\u00e9e g\u00e9n\u00e9rale, <strong>elle doit \u00eatre soumise au vote de l\u2019ensemble des copropri\u00e9taires<\/strong>.<\/p>\n<p style=\"text-align: justify\">Tous les sujets ne sont pas trait\u00e9s de la m\u00eame mani\u00e8re et les majorit\u00e9s changent selon\u00a0:<\/p>\n<ul>\n<li style=\"text-align: justify\">Le sujet abord\u00e9<\/li>\n<li style=\"text-align: justify\">Leur importance sur le fonctionnement de la copropri\u00e9taire<\/li>\n<li style=\"text-align: justify\">Leur impact budg\u00e9taire sur la comptabilit\u00e9 de la copropri\u00e9t\u00e9<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Sachez \u00e9galement que le vote d\u2019un copropri\u00e9taire correspond \u00e0 un nombre variable de voix selon sa quote-part des parties communes.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;font-size: 24px;padding-left: 80px\"><span style=\"text-decoration: underline\"><strong>Les d\u00e9cisions vot\u00e9es \u00e0 la majorit\u00e9 absolue<\/strong><\/span><\/h4>\n<p style=\"text-align: justify\">La majorit\u00e9 absolue correspond \u00e0 la moiti\u00e9 des voix\u00a0+1.
