Que vous soyez propri\u00e9taire occupant, investisseur ou bailleur, votre appartement fait partie d\u2019un ensemble r\u00e9gi par des r\u00e8gles pr\u00e9cises. Ces r\u00e8gles, inscrites dans le <strong>Code civil belge<\/strong>, organisent la gestion des parties communes et les relations entre copropri\u00e9taires.<\/p>\n<p>Dans cet article, nous faisons le point sur le droit de la copropri\u00e9t\u00e9, ce que dit la loi et ce que vous devez savoir pour bien comprendre vos droits et obligations.<\/p>\n<h2><strong>La base l\u00e9gale : le Code civil<\/strong><\/h2>\n<p>La copropri\u00e9t\u00e9 en Belgique est r\u00e9gie par les articles <strong>577-3 \u00e0 577-14 du Code civil<\/strong>. Ces dispositions, au c\u0153ur du droit de la copropri\u00e9t\u00e9, encadrent :<\/p>\n<ul>\n<li>la <strong>cr\u00e9ation de la copropri\u00e9t\u00e9<\/strong> (acte de base et r\u00e8glement de copropri\u00e9t\u00e9),<\/li>\n<li>la <strong>r\u00e9partition des charges et des droits<\/strong>,<\/li>\n<li>le <strong>fonctionnement des organes de gestion<\/strong> (assembl\u00e9e g\u00e9n\u00e9rale, syndic, conseil de copropri\u00e9t\u00e9),<\/li>\n<li>et la <strong>r\u00e9solution des litiges<\/strong>.<\/li>\n<\/ul>\n<p>L\u2019objectif est clair : <strong>assurer une gestion harmonieuse de l\u2019immeuble<\/strong> et pr\u00e9venir les conflits entre voisins, qui peuvent vite empoisonner la vie quotidienne. Pour cela, le respect des r\u00e8gles \u00e9tablies et une communication transparente sont essentiels.<\/p>\n<p><strong>Exemple concret : <\/strong>si un ascenseur doit \u00eatre remplac\u00e9, la d\u00e9cision de le faire, la r\u00e9partition des co\u00fbts et le suivi des travaux se feront dans le cadre de ces r\u00e8gles l\u00e9gales.es conflits.<\/p>\n<h2><strong>Les organes de la copropri\u00e9t\u00e9<\/strong><\/h2>\n<p><img decoding=\"async\" src=\"https:\/\/contenu.nyc3.cdn.digitaloceanspaces.com\/journalist\/f22e7da5-eafd-4ed9-8ef5-b1c377f7d4b1\/thumbnail.jpeg\" alt=\"People discussing at a table during a meeting.\" \/><\/p>\n<h3><strong>L\u2019assembl\u00e9e g\u00e9n\u00e9rale (AG)<\/strong><\/h3>\n<p>C\u2019est <strong>l\u2019organe souverain de la copropri\u00e9t\u00e9<\/strong>. L\u2019AG r\u00e9unit tous les copropri\u00e9taires au moins une fois par an et prend les d\u00e9cisions importantes concernant l\u2019immeuble : approbation des comptes, adoption du budget, d\u00e9signation du syndic, travaux de r\u00e9novation, etc.<\/p>\n<p>Les d\u00e9cisions se prennent selon diff\u00e9rentes majorit\u00e9s, en fonction de leur importance :<\/p>\n<ul>\n<li><strong>Majorit\u00e9 simple<\/strong> (plus de 50 %) : entretien et gestion courante.<\/li>\n<li><strong>Majorit\u00e9 des 2\/3<\/strong> : travaux aux parties communes (par exemple, r\u00e9novation de la fa\u00e7ade).<\/li>\n<li><strong>Majorit\u00e9 des 4\/5<\/strong> : modification de la repartition des charges communes et\u00a0 du r\u00e8glement.<\/li>\n<\/ul>\n<p><strong>Unanimit\u00e9<\/strong> : Modifications fondamentales de l\u2019acte de base comme les quotit\u00e9s.<\/p>\n<h3><strong>Le syndic<\/strong><\/h3>\n<p>Le <strong>syndic<\/strong> est le repr\u00e9sentant l\u00e9gal de la copropri\u00e9t\u00e9. Il est charg\u00e9 de :<\/p>\n<ul>\n<li>ex\u00e9cuter les d\u00e9cisions de l\u2019AG,<\/li>\n<li>g\u00e9rer les finances (appels de fonds, paiement des factures),<\/li>\n<li>convoquer les assembl\u00e9es,<\/li>\n<li>veiller \u00e0 l\u2019entretien et \u00e0 la s\u00e9curit\u00e9 des parties communes.<\/li>\n<\/ul>\n<p>Depuis <strong>2010<\/strong>, la d\u00e9signation d\u2019un syndic est obligatoire. Il peut s\u2019agir d\u2019un <strong>professionnel inscrit \u00e0 l\u2019IPI<\/strong> (Institut professionnel des agents immobiliers) ou d\u2019un <strong>syndic b\u00e9n\u00e9vole<\/strong> \u00e9lu parmi les copropri\u00e9taires.<\/p>\n<h3><strong>Le conseil de copropri\u00e9t\u00e9<\/strong><\/h3>\n<p>Obligatoire dans les <strong>grandes copropri\u00e9t\u00e9s (plus de 20 lots)<\/strong>, il assiste le syndic et en contr\u00f4le la gestion. Il fait office de relais entre les copropri\u00e9taires et le syndic.<\/p>\n<h2><strong>3. Les charges et les quotes-parts<\/strong><\/h2>\n<p>Chaque copropri\u00e9taire doit contribuer aux frais de l\u2019immeuble. Ces contributions se font en fonction des <strong>quotit\u00e9s<\/strong> attribu\u00e9es \u00e0 chaque appartement, calcul\u00e9es dans l\u2019acte de base selon la valeur de chaque lot.<\/p>\n<p>Deux types de charges existent :<\/p>\n<ul>\n<li><strong>Les charges communes ordinaires<\/strong> (entretien, nettoyage, \u00e9lectricit\u00e9 des parties communes).<\/li>\n<li><strong>Les charges extraordinaires<\/strong> (travaux, r\u00e9parations importantes).<\/li>\n<\/ul>\n<h2><strong>Les droits et obligations des copropri\u00e9taires<\/strong><\/h2>\n<p>En tant que copropri\u00e9taire, vous disposez :<\/p>\n<ul>\n<li>du <strong>droit de jouir<\/strong> de votre bien et des parties communes,<\/li>\n<li>du <strong>droit de vote<\/strong> en assembl\u00e9e g\u00e9n\u00e9rale,<\/li>\n<li>du <strong>droit de consultation<\/strong> des documents (comptes, contrats, proc\u00e8s-verbaux).<\/li>\n<\/ul>\n<p>Mais vous avez aussi des obligations :<\/p>\n<ul>\n<li>respecter le r\u00e8glement d\u2019ordre int\u00e9rieur,<\/li>\n<li>payer vos charges dans les d\u00e9lais,<\/li>\n<li>ne pas nuire aux autres copropri\u00e9taires (bruits, d\u00e9gradations, usage abusif des parties communes).<\/li>\n<\/ul>\n<h2><strong>La r\u00e9solution des litiges<\/strong><\/h2>\n<p>Les litiges en copropri\u00e9t\u00e9 sont fr\u00e9quents : contestation de charges, opposition \u00e0 des travaux, conflits avec le syndic.<\/p>\n<ul>\n<li><strong>La m\u00e9diation<\/strong> est souvent encourag\u00e9e, car elle permet de trouver un compromis rapidement.<\/li>\n<li>\u00c0 d\u00e9faut d\u2019accord,le juge de paix ou le tribunal de premi\u00e8re instance peut \u00eatre saisi. Il a comp\u00e9tence exclusive en mati\u00e8re de copropri\u00e9t\u00e9, selon les principes du <strong>droit de la copropri\u00e9t\u00e9<\/strong>.<\/li>\n<\/ul>\n<h2><strong>Les r\u00e9formes r\u00e9centes<\/strong><\/h2>\n<p>La loi sur la copropri\u00e9t\u00e9 a connu plusieurs r\u00e9visions, notamment en <strong>2010<\/strong> et en <strong>2018<\/strong>, pour :<\/p>\n<ul>\n<li>renforcer la transparence financi\u00e8re,<\/li>\n<li>professionnaliser le r\u00f4le du syndic,<\/li>\n<li>faciliter la prise de d\u00e9cision en assembl\u00e9e g\u00e9n\u00e9rale,<\/li>\n<li>am\u00e9liorer la protection des copropri\u00e9taires minoritaires.<\/li>\n<\/ul>\n<p>Ces r\u00e9formes visent \u00e0 adapter la l\u00e9gislation \u00e0 la r\u00e9alit\u00e9 des copropri\u00e9t\u00e9s modernes et \u00e0 pr\u00e9venir les blocages.<\/p>\n<h2><strong>Conclusion<\/strong><\/h2>\n<p>La copropri\u00e9t\u00e9 en Belgique repose sur un \u00e9quilibre entre <strong>les droits individuels<\/strong> et <strong>l\u2019int\u00e9r\u00eat collectif<\/strong>.
